- 인권적 관점에서 본 대한민국 국적법의 제⋅개정 -
국적이란 한 국가의 국민으로서의 지위 또는 국민으로서의 법적 자격을 의미하는 것이다. 그리고 각국의 국적법은 그 국민이 되는 요건을 그 나라의 영토주권과 혈통, 민족적 계열성 등 그들만의 기준 으로 인정하고 있다. 국적의 부여와 상실 결정은, 국가적인 정책에 속하는 문제이기는 하지만 개인의 의사나 의지 또한 존중되어야 하는 영역이다. 우리나라 국적법도 1948년 제정된 이후 16차례에 걸쳐 개정되었다. 우리나라도 1980년대 이후 급격히 다문화사회로 이행되면서 국적법은 이민법제의 중요한 부분이 되었고, 국적은 이해당사자들의 인권보호와도 관련을 지니게 되었다. 본 연구는 우리나라 제정 국적법에서 현행 국적법에 이르기까지의 내용을 인권적 관점에서 분석하여 그 의미를 논하고자 한 것 이다. 따라서 서론에서는 연구의 필요성을, 제2장에서는 국적법의 제정경위와 기본원칙, 주요 내용을 중심으로 살펴보았다. 그리고 제3장에서는 국적법의 개정을 개관하고 개정시기별 주요내용을 중심으 로 정리, 분석하였다. 제4장에서는 평등권과 자유권을 기초로 한 인권적 관점으로 제정국적법과 개정 국적법을 항목을 나누어 분석하고, 평가하였다. 연구의 결과 우리나라 국적법은 초창기에 비하여 훨씬 개방적이고 인권친화적으로 개정되어 왔으며, 개인의 지유로운 의사를 존중하면서 인권을 최대한 보장 하려는 노력을 하고 있다는 결론을 얻었다. 그러나 아직도 일반귀화의 요건이나 복수국적제도 등은 인 권적 관점에서 보아 미흡한 부분도 있어 개선을 위한 제언도 하였다.
Enactment and Amendment of Korean Nationality Act from Human Rights Perspective
Nationality refers to a status of a citizen of the country or the legal rights as a citizen. Each country has its own nationality laws recognizing different requirements in becoming a citizen, such as territorial sovereignty, lineage, and ethnicity. The decision of acquisition of nationality or abandonment of nationality is a matter that falls under national policy; however, it is an area that individual’s opinion should also be respected. South Korea’s Nationality Act has been established in 1948, and since then it has been revised 16 times. As South Korea rapidly transitioned to a multicultural society since the 1980s, the Nationality Act has become an important part of the immigrations legislation, and nationality played an important role regarding with the protection of human rights of stakeholders. The purpose of this research is to analyze the contents of Korean Nationality Act in terms of human rights and to discuss the meaning of it. In the introduction, the necessity of the research was examined; in Chapter two, the process of enacting the Nationality Act, and its basic principles and main contents were examined. Chapter three outlines the revision of the Nationality Act by organizing and analyzing the main contents of each revision period. Chapter four analyze and evaluate the enacted Nationality Act and the Nationality Act in terms of human rights based on the right to equality and freedom. It was concluded that South Korea’s Nationality Act has been revised to be more open and more human rights friendly compared to the early days; it is making efforts to ensure human rights as much as possible while respecting individual’s opinion. However, there are still insufficient parts in the perspective of human rights; accordingly, improvement suggestions were made.
